What is the difference between guarantee and warranty?

The warranty right for the customer (consumer) arises from §§ 437 ff. of the German Civil Code (BGB) and covers all defects that were present at the time the goods were handed over. Even if these defects only become apparent at a later date, they are covered by the warranty right. In this case, the statutory warranty period is 24 months. For transactions between companies (B2B), the warranty period is 12 months. The product warranty is a voluntary service provided by the manufacturer and must be processed via the manufacturer. Which defects are covered and to what extent depends on the manufacturer and the product.
